Terms of Service

1. Acceptance of Terms

By purchasing a WPfaker subscription or using our services, you agree to be bound by these Terms of Service. If you do not agree, do not use our services.

2. Open Source License

WPfaker ("the Plugin") is free software released under the GNU General Public License, version 2 (GPLv2) or later. Under the GPL, you are free to:

  • Use the Plugin for any purpose
  • Study and modify the source code
  • Redistribute copies of the original or modified Plugin

Nothing in these Terms restricts or limits any rights granted to you by the GPL. In the event of any conflict between these Terms and the GPL, the GPL prevails with respect to the Plugin's source code.

3. What You Purchase

When you purchase a WPfaker subscription, you are buying access to our commercial services, not the Plugin code itself. These services include:

  • Automatic Updates: Access to plugin updates delivered through our update server.
  • Support: Access to our support system for help with the Plugin.
  • License Key: A key that activates the update and support services.

Subscription types:

  • Yearly Subscription: Valid for 365 days from the date of purchase. Auto-renews unless cancelled.
  • Lifetime Subscription: Valid indefinitely. Includes all future updates and support.
  • Each subscription covers an unlimited number of websites you own or manage.

4. Service Terms

Regarding our commercial services (updates, support, license keys):

  • License keys are personal to your account and should not be shared publicly or with third parties
  • We reserve the right to revoke access to our services if keys are abused (e.g. distributed publicly or used for unauthorized commercial redistribution of our services)
  • You may not use our update server or support system for any illegal purpose

These restrictions apply only to our services. They do not limit your rights under the GPL with respect to the Plugin's source code.

5. Payment and Refunds

All payments are processed by Creem. Prices are in USD and may change at any time. Price changes do not affect existing subscriptions until renewal. All sales are final.

6. Updates and Support

Your subscription includes access to plugin updates via our update server and support via our support system. We aim to respond to support requests within 48 hours on business days. We reserve the right to modify, suspend, or discontinue any service feature at our discretion.

7. Disclaimer of Warranties

Our services and the Plugin are provided "as is" without warranties of any kind, express or implied. We do not warrant that the Plugin will be error-free, uninterrupted, or compatible with every WordPress configuration.

8. Limitation of Liability

In no event shall WPfaker or its creators be liable for any indirect, incidental, special, or consequential damages arising from your use of the Plugin or our services. Our total liability shall not exceed the amount paid for your subscription in the 12 months preceding the claim.

9. Termination

We may terminate your access to our services if you violate these Terms. Termination of services does not affect your rights under the GPL. Sections 2, 7, 8, and 10 survive termination.

10. Governing Law

These Terms are governed by the laws of Germany. Any disputes shall be resolved in the courts of Frankfurt am Main, Germany.
